Update on Form I-134A

Due to the Jan. 20, 2025 Executive Order, Securing Our Borders, USCIS is pausing acceptance of Form I-134A, Online Request to be a Supporter and Declaration of Financial Support, until we review all categorical parole processes as required by that order.

On January 23, 2025, the Department of Homeland Security (DHS) announced a pause of the Uniting for Ukraine (U4U) Parole Program, a special program implemented after Russia’s invasion of Ukraine that permits Ukrainians seeking temporary refuge to travel to and work in the United States.
The DHS directive halts the review and adjudication of both initial and renewal parole applications under the U4U program. While not officially terminated, the directive suggests that DHS will not accept new applications for initial parole periods or renewal (or “reparole”) applications for those seeking to extend their parole in the United States. During an undetermined review period, individuals outside the United States should not expect decisions on pending applications, and those currently in the United States are strongly encouraged to explore alternative options to maintain legal status and work authorization. 

The best policy at this time is to avoid International Travel: Foreign nationals with Advance Parole or similar travel authorizations are advised not to leave the United States. Due to heightened scrutiny at ports of entry, travelers risk being denied reentry and may face expedited removal proceedings. Those seeking reentry have reportedly been asked to voluntarily depart or risk detention. 

However, recently the CBP posted this update, advising travelers that the old form I-512, Advance Parole, are still acceptable documents for reentry to the United States.

​DHS to Extend Temporary Protected Status for Ukraine

Extension Allows Eligible Ukrainian Nationals Who Arrived on or Before August 16, 2023, to Maintain TPS and Employment Authorization Following Vetting

WASHINGTON – The Department of Homeland Security announced today the extension of Temporary Protected Status (TPS) for Ukraine for 18 months. The extension of TPS is due to ongoing armed conflict and extraordinary and temporary conditions in Ukraine that prevent eligible Ukrainian nationals from safely returning.

After reviewing the country conditions in Ukraine and consulting with interagency partners, it was determined that an 18-month TPS extension is warranted because of conditions resulting from the expansion of the Russian military invasion into Ukraine, the largest conventional military action in Europe since World War II. Russia’s expanded military invasion has led to high numbers of civilian casualties and reports of war crimes and crimes against humanity committed by Russian military forces and officials. This invasion has caused a humanitarian crisis, with significant numbers of individuals fleeing and damage to civilian infrastructure that has left many without electricity or access to medical services. These conditions prevent Ukrainian nationals and habitual residents from safely returning. Such a determination meets the statutory obligation to decide, at least 60 days before the expiration of a TPS designation, whether the conditions for designation continue to be met and merit an extension.

The extension of TPS for Ukraine allows approximately 103,700 current eligible beneficiaries to re-register for TPS, if they continue to meet eligibility requirements. Re-registration is limited to individuals who previously registered for TPS under Ukraine’s designation. This population includes nationals of Ukraine (and individuals without nationality who last resided in Ukraine) who have been continuously residing in the United States since at least August 16, 2023, with or without lawful immigration status. Every individual processed by the Department of Homeland Security goes through rigorous national security and public safety vetting during the original application process and again during re-registration. If any individual is identified as posing a threat, they may be detained, removed, or referred to other federal agencies for further investigation or prosecution as appropriate. Individuals are barred from TPS if they have been convicted of any felony or two misdemeanors.

DHS recognizes that not all re-registrants may receive a new Employment Authorization Document before their current EAD expires and is automatically extending for 12 months the validity of EADs previously issued under Ukraine’s TPS designation.

U.S. Citizenship and Immigration Services (USCIS) will continue to process pending applications filed under the Ukraine designation. Both initial applicants and re-registering current beneficiaries who have a pending Form I-821 or Form I-765 do not need to file either application again. If USCIS approves an individual’s pending Form I-821, USCIS will grant them TPS through October 19, 2026. Similarly, if USCIS approves a pending TPS-related Form I-765, USCIS will issue the individual a new EAD that will be valid through the same date.  

A soon-to-be-published Federal Register notice will explain the eligibility criteria, timelines, and procedures necessary for current beneficiaries to re-register and renew EADs.

Eligible Ukrainians Can Now Apply for Re-Parole - Form I-131 with a Filing Fee.

С 11 октября 2024 новая форма заявления I-131 заменила старую форму (edition date 06/17/2024). Новая форма I-131 имеет 14 страниц вместо 5, и много новых опций. Будьте внимательны выбирая опцию для Украины как онлайн так и в бумажной форме. Смотрите на странице 4 в бумажной форме. Госпошлина за эту опцию re-parole for Ukraine $630 (или на $50 дешевле, если подается онлайн). 

Начиная с 27 февраля 2024 украинцы, находящиеся в США по гуманитарному паролю в связи с войной, могут подать заявление на продление парол

Помните, что с 1 апреля 2024 вступают в силу новые госпошлины.

Beginning Feb. 27, 2024, certain Ukrainian citizens and their immediate family members displaced by the war and paroled into the United States on or after Feb. 11, 2022, will be able to apply for a new period of parole (also known as re-parole) for up to two years. USCIS will consider these applications on a discretionary, case-by-case basis for urgent humanitarian reasons or significant public benefit. To apply for re-parole, eligible applicants should submit Form I-131, Application for Travel Document, with the appropriate filing fee through a USCIS online account to save time and reduce errors commonly found on paper-filed forms that can lead to delays. Once approved for re-parole, Ukrainians can then apply for an initial or renewal Employment Authorization Document with USCIS. 

To be eligible for re-parole under this process, you must demonstrate the following: 
  • That you are a Ukrainian citizen or their immediate family member who was paroled into the United States on or after Feb. 11, 2022; 
  • That there are continued urgent humanitarian reasons or significant public benefit for issuance of a new period of parole, including the urgent humanitarian reasons or significant public benefit factors identified above, as well as any additional factors; 
  • That you warrant a favorable exercise of discretion; 
  • That you are physically present in the United States; 
  • That you have complied with the conditions of the initial parole; and 
  • That you clear biographic and biometric background checks. 
You can find your initial date of parole on your Form I-94, Arrival/Departure Record, issued by U.S. Customs and Border Protection.
It is important that you file your application for re-parole before the end of your initial parole period. If circumstances allow, USCIS recommends filing your application for re-parole no later than 60 days before the last day of your initial parole period.  

Required Documents
You must use Form I-131 to request re-parole. You can submit Form I-131 online or on paper by mail. You do not need to file Form I-134, Declaration of Financial Support, or Form I-134A, Online Request to be a Supporter and Declaration of Financial Support, as a supporter is not required for re-parole. Regardless of whether you apply for re-parole online or on paper by mail, you must provide documentation to confirm your initial period of parole and identity, including your photo, name, and date of birth. Examples include: 
  • Form I-94; 
  • A copy of both sides of your USCIS-issued Employment Authorization Document (EAD), if you applied for and received one; 
  • A copy of both sides of your U.S. government-issued driver’s license or U.S. government- issued ID, if you applied for and received one; or 
  • A copy of the identity (biographical) page of your passport and copies of all admission and parole stamps in your passport for entries into the United States. Please note that children may be included in a parent’s Ukrainian passport; in such cases, the children’s information will not be on the identity page. 
If you submit any document containing information in a foreign language to USCIS, you must include a full English language translation that the translator has certified as complete and accurate and include the translator’s certification that they are competent to translate from the foreign language into English. 

Employment Authorization
If USCIS approves your application for re-parole, you can then apply separately for a new EAD, for the duration of your new period of parole, by submitting Form I-765, Application for Employment Authorization, to USCIS after they approve your re-parole.

If you file Form I-765 before grant of re-parole, USCIS may deny your Form I-765, and will not refund any associated fees. You can apply for an EAD through a USCIS online account. 
 

While their new EAD application is pending, parolees who have received re-parole may be able to show their new Form I-94 (issued following the grant of re-parole) as acceptable evidence of identity and employment authorization for a period of up to 90 days from the date they are hired (or for reverification of employment eligibility when the initial EAD expires).  To use the I-94 for this purpose, a parolee must have been:  
  • Granted re-parole as a certain Ukrainian citizen or an immediate family member;  
  • Have a most recent date of entry on or before Sept. 30, 2023; and  
  • Have a new I-94 with “UHP” listed as the class of admission.  
Within 90 days, the employee must present an unexpired EAD or unrestricted Social Security card and a List B identity document such as a state-issued driver’s license or identification card to meet the Form I-9 requirements.   

Have You Moved? 
As a condition of your parole, you must update your address with USCIS each time you move and within 10 days of moving. We strongly encourage you to change your address through your USCIS online account. This will help ensure you receive all correspondence and benefits from us in a timely manner and avoid possible delays.

Frequently Asked Questions 
What do I need to know to complete the Form I-131 for re-parole? 
 On the online form, this will be the first question under the first section, called “Basis of Eligibility.” In the same section you must also select “yes” to the question, “Are you applying for re-parole?” 
  
On the paper form, this option is located in part 2, item 1.e. You also must write “Ukraine Re-Parole” at the top of the form if you file on paper and mail your form to the designated filing location.

How much does it cost to apply for re-parole? 
The current Form I-131 filing fee is $575. There is no cost for biometric services. If you want to request a fee waiver, you must file Form I-131 on paper. You cannot apply for re-parole online if you are submitting a fee waiver request.  
  
Note: Our fees will be changing on April 1, 2024. Before filing, you should always check for the most up-to-date filing fee by visiting the Form I-131 page. 
 

Do I need to apply for a new EAD to be able to continue working? 
Yes. If your application for re-parole is approved, you may file Form I-765 through your USCIS online account. Do not file your Form I-765 until after we approve your re-parole application. Eligible parolees whose Form I-765 is approved will receive an EAD that they can present to their employer for Form I-9, Employment Eligibility Verification.  
  
If you are approved for re-parole, you may be able to use your updated I-94 as an acceptable identity and work authorization document for a limited time while USCIS adjudicates your Form I-765, if you were paroled on or before Sept. 30, 2023.  Individuals who receive a Form I-131 approval notice showing a new period of parole should visit the U.S. Customs and Border Protection Form I-94 website to view and print a copy of their new Form I-94. If USCIS approves your re-parole application, the updated I-94 will show a “class of admission” of “UHP.” 
  
For parolees who are granted re-parole and whose new, unexpired Form I-94 includes a UHP class of admission and a “Most Recent Date of Entry” on or before Sept. 30, 2023, the Form I-94 is an acceptable List A receipt that shows their identity and employment authorization for Form I-9, Employment Eligibility Verification. This satisfies the Form I-9 requirement for 90 days from the date of hire (or in the case of reverification, the date employment authorization expires). 
 
After the 90-day period, parolees must present an unexpired EAD, or unrestricted Social Security card and acceptable List B identity document from the Form I-9 Lists of Acceptable Documents (such as a state-issued driver’s license or identification card). We recommend filing Form I-765 as soon as we approve your re-parole application. USCIS will provide additional guidance to employers about completion of the Form I-9. 
  

My first EAD is expiring soon. Will USCIS waive the filing fee for my second EAD? 
No. While USCIS did not initially require a filing fee for most of the parolees who are now eligible to apply for this process, you must submit Form I-765 for your second EAD, and include the current filing fee of $410. Before you file, check for the most up-to-date filing fee by visiting the Form I-765 page.  
  
If you want to request a fee waiver, you must file Form I-765 on paper. You cannot apply for an EAD online if you are submitting a fee waiver request. 
 

If I request a fee waiver, will it affect my application? 
 
No. Requesting a waiver of the Form I-765 fee does not affect the adjudication of your employment authorization. 
 

Do I need to file any other forms to apply for re-parole? 
No. You only need to file Form I-131 with the required supporting documents to apply for re-parole.  
 

How soon can I file for re-parole? 
 
It is important that you file your application for re-parole before the end of your initial parole period. If circumstances allow, USCIS recommends filing your application for re-parole no later than 60 days before the last day of your initial parole period. We will be prioritizing cases based on parole expiration dates. 
 

What if my initial parole expires while my re-parole application is pending?  After your initial parole expires, you no longer are in an authorized period of stay unless you have been granted an immigration status, such as asylum or TPS, or are otherwise in an authorized period of stay, such as if you have a pending asylum, TPS, or Green Card application. We encourage you to file your re-parole application as soon as possible.

  • Create your free USCIS online account today to apply for re-parole. By applying online, you can prevent common mistakes on your forms. If you already have an account, confirm that you have access to it. Through a USCIS online account, you can check the status of your case, access your notices from USCIS, communicate with us, and respond to requests for evidence. Even if you plan to apply for re-parole and for a new EAD by paper, you are still encouraged to create a USCIS online account to check on your case status and access USCIS notices. 
  • Update your address through your USCIS online account or follow the information provided on our How to Change Your Address webpage if you are filing on paper. This will help to ensure you receive all correspondence and benefits in a timely manner. 
  • Review and ensure completion of all attestation requirements through your USCIS online account, including:
    • An attestation that you have completed vaccine requirements or are eligible for an exception to vaccine requirements for measles, polio, and the first dose of an FDA-approved or -authorized COVID-19 vaccine or a WHO-Emergency use listed (EUL) COVID-19 vaccine. 
    • An attestation that you received a medical screening for tuberculosis, including an Interferon-Gamma Release Assay (IGRA) test, within 90 days. 
  • Gather all required documents. 
  • Timely apply for re-parole before your initial parole period ends.

Ukraine Redesignated for TPS from October 2023 to April 19 2025

18 августа 2023 Миграционная Служба США объявила о продлении временного гуманитарного статуса ТПС для украинцев еще на 18 месяцев с 20 октября 2023 по 19 апреля 2025. Все те кто находятся в США на 16 августа 2023 теперь могут подать новое заявление на ТПС (если ранее не было) или продлить ваш период ТПС на 18 месяцев.
Все заявления лучше всего подать онлайн.
Тем у кого оно есть разрешение на работу по ТПС, разрешение на работу или work permit (EAD) будет продлено автоматически на год до 19 октября 2024, при условии, что вы подали на пере-регистрацию ТПС.
Студентам с Украины разрешено подавать на разрешение на работу по новому правилу, и также разрешено уменьшить количество часов в в колледже.

On August 18, 2023, the Department of
 Homeland Security USCIS announced an extension of Temporary Protected Status (TPS) for Ukraine for 18 months, from October 20, 2023, through April 19, 2025. In addition, DHS announced a redesignation of TPS for Ukraine, allowing Ukrainian nationals (and individuals having no nationality who last habitually resided in Ukraine) residing in the United States as of August 16, 2023, to be eligible for TPS. 


Accompanying this announcement is a Special Student Relief notice for F-1 nonimmigrant students whose country of citizenship is Ukraine so the students may request employment authorization, work an increased number of hours while school is in session, and reduce their course load while continuing to maintain F-1 status through the TPS designation period. 

The extension allows approximately 26,000 current beneficiaries to retain TPS through April 19, 2025, if they continue to meet TPS eligibility requirements. 

An estimated 166,700 additional individuals may be eligible for TPS under the redesignation of Ukraine. This population includes nationals of Ukraine (and individuals without nationality who last resided in Ukraine) in the United States in nonimmigrant status or without lawful immigration status.

Current beneficiaries who wish to extend their temporary protected status must re-register in a timely manner during the 60-day re-registration period from August 21, 2023 through October 20, 2023 to ensure they keep their TPS and employment authorization without a gap. USCIS is automatically extending EADs previously issued through October 19, 2024.

USCIS will continue to process pending applications filed under previous TPS designations for Ukraine. Individuals with a pending Form I-821, Application for Temporary Protected Status, or a related Form I-765, Application for Employment Authorization, do not need to file either application again. If USCIS approves a pending Form I-821 or Form I-765 filed under the previous designation of TPS for Ukraine, USCIS will grant the individual TPS through April 19, 2025, and issue an EAD valid through the same date.

Initial, first-time applicants for TPS under the redesignation of Ukraine must submit Form I-821, Application for Temporary Protected Status, during the initial registration period that runs from August 21, 2023 through April 19, 2025. Applicants may file Form I-821 online. When filing a TPS application, applicants can also request an EAD by submitting a completed Form I-765, Application for Employment Authorization, with their Form I-821, or separately at a later date. Applicants may also submit Form I-765 online.

The Federal Register notice explains the eligibility criteria, timelines, and procedures necessary for current beneficiaries to re-register and renew EADs, and for new applicants to submit an initial application under the redesignation and apply for an EAD.

New Bill Introduced in 118th Congress: H.R.3911 - To provide for adjustment of status of nationals of Ukraine

Недавно в 118 Конгресс США был предоставлен новый законопроект Ukrainian Adjustment - суть которого в предоставлении постоянного вида на жительство или грин карт для граждан Украины, приехавших в США после начала военных действий в 2022.

Пока не известны детали этого законопроекта, в частности - кто будет иметь право подать заявление на грин карту (что касается членов семьи, которые не являются гражданами Украины), какие условия, когда, как подавать, стоимость и т.п. И пока не известно, пройдет ли этот законопроект и станет ли он Законом

Filing Tips for Supporters and Beneficiaries of

U.S. Citizenship and Immigration Services (USCIS) is receiving many duplicate filings of Form I-134A, Online Request to be a Supporter and Declaration of Financial Support, and related inquiries to our Contact Center. These tips will help you properly submit Form I-134A as well as correct any errors you discover after you submit it.
Duplicate Filings of Form I-134A
Some potential supporters are filing multiple Forms I-134A for the same beneficiary. This adds to our workload, which delays processing. Please do not file more than one Form I-134A for the same beneficiary as this may delay processing of the beneficiary you are agreeing to support. Please understand that it may take some time to process your request. If you have not received a decision on a Form I-134A you filed on behalf of a beneficiary, the best way that you can check your case status is through your USCIS online account. Do not file another Form I-134A for that beneficiary until you receive a decision on the first Form I-134A filed.
Potential supporters who wish to support more than one beneficiary must file one Form I-134A for each beneficiary. Do not submit duplicate Forms I-134A for the same beneficiary.
How to Check Case Status
After you file Form I-134A with USCIS, we will send you a receipt notice to indicate that we received your request. Please remember that processing of your Form I-134A may take some time, however, we are working on your request as quickly as we can. To get up-to-date information about a case, enter the receipt number (which begins with IOE) into Case Status Online at uscis.gov/casestatus. As mentioned above, you can also get case status in your USCIS online account.

Which Form to Use
As of Jan. 6, 2023, potential supporters must use the new Form I-134A, instead of Form I-134, Declaration of Financial Support. If you submitted Form I-134 online before Jan. 6, 2023, we will continue to process your case; you do not need to file a new form.

How to Avoid Delays
We are receiving many Forms I-134A with multiple typos and errors.
  • If you wish to be a supporter, review all the information on Form I-134A before you submit it. Common mistakes include: misspelling the beneficiary’s name; incorrect dates of birth; incorrect passport numbers; and incorrect email addresses.
  • If USCIS confirms your Form I-134A, which means USCIS has approved your request to be a supporter, and the beneficiary’s email address is incorrect, they will not receive the email with instructions to set up their online account, verify their biographical information, and complete other next steps to be considered for parole. It is important for supporters to enter the correct email address for the beneficiary, otherwise, they would need to contact USCIS to request a correction to the email address they entered for the beneficiary, causing additional delays.
  • If you are a beneficiary, carefully review all the information your supporter entered about you before you submit your biographical information to U.S. Customs and Border Protection (CBP). Check for misspellings in your name, incorrect date of birth, or mistyped passport number. Any typographical errors in what you submit to CBP can delay your application.

11 апреля 2023 Госдума РФ приняла поправки к закону "О воинской обязанности и воинской службе", позволяющие вручать повестки не только в бумажном, но и в электронном виде через Госуслуги. 

Согласно новому закону, повестки теперь будут направлять в письменной форме и дублировать в электронной. При этом электронная повестка считается врученной с момента ее размещения в личном кабинете гражданина "на соответствующем информационном ресурсе, в информационной системе ("Госуслуги").

Бумажные повестки отменены не будут, но теперь их можно будет отправлять и заказным письмом. Такая повестка будет считаться врученной и в том случае, если гражданин откажется ее получать.

Другое новшество, которое предполагают поправки, - дистанционная постановка россиян на первоначальный воинский учет на основании сведений из государственных информационных систем. Также военкоматы смогут при наличии оснований зачислять военнообязанных в запас без их личной явки.

Запрет на выезд из РФ и другие ограничения для уклонистов

Принятые Госдумой поправки к закону "О воинской службе" предусматривают и ряд ограничений для тех, кто попытается уклониться от явки в военкомат. В частности, получившим повестку военнообязанным со дня ее вручения запрещается выезд за пределы РФ.На то, чтобы явиться в комиссариат, дается 20 дней. По истечении этого срока призывнику запретят оформлять кредиты и займы, а также регистрировать ИП, недвижимость и автомобили. Также он лишится права управлять транспортными средствами. 

Мужчины от 18 до 27 лет в группе призывного возраста. Мужчины другого возраста тоже могут попасть под призыв и запрет на выезд из США.

Extension for U4U Uniting for Ukraine Rules

Extension for Certain Ukrainians Paroled into the United States.

Certain Ukrainian nationals and immediate family members were paroled into the United States last year, on a case-by-case basis for urgent humanitarian reasons, during an approximate eight-week period after Russia’s unprovoked invasion of Ukraine and before the Uniting for Ukraine process was available. Such individuals were generally paroled for a period of one year, while participants in Uniting for Ukrainereceived a two-year period of parole.

With hostilities in Ukraine entering their second year, DHS assesses that there remain urgent humanitarian reasons, as well as a significant public benefit, for extending the parole of certain Ukrainians who arrived prior to Uniting for Ukraine. DHS will consider Ukrainian nationals and immediate family members who were paroled, on a case-by-case basis, before Uniting for Ukraine for an extension of the parole period and employment authorization, if applicable.

Specifically, individuals paroled into the United States at a port of entry between February 24, 2022 and April 25, 2022 will be considered for an extension. DHS is in the process of considering these individuals, on a case-by-case basis, for a one-year extension of their period of parole to align with the two-year parole period provided under Uniting for Ukraine. DHS estimates it will take approximately four weeks to consider and vet all the individuals in the group and will review cases based on the date of parole.

If an individual’s parole period is extended, DHS will proactively make available online an updated Form I-94 with the extended parole period. The period of parole will be extended from the current expiration date without a gap. Individuals can retrieve and download an updated Form I-94 as evidence of their extended parole period by visiting CBP’s Form I-94 website.

Those who have their period of parole extended will also be eligible to receive employment authorization for the additional year. Individuals who have Employment Authorization Documents (EADs) based on their parole and whose parole period is extended for an additional year will receive a Form I-797C from USCIS that can be used to demonstrate continued employment authorization through the extended parole period.  The Form I-797C will be mailed to the address on file with USCIS.  If you need to change your address, please change your address online through your existing USCIS online account or using the Form AR-11, Alien’s Change of Address Card, online using the Change of Addresspage.
  • If you are part of this group but do not see an updated Form I-94 online by early April 2023, please submit an inquiry to Ask Us a Question (cbp.gov)

Ukrainian parolees may pursue multiple immigration pathways at the same time and this process does not impact other benefit requests including those who have applied for Temporary Protected Status (TPS), been granted TPS, or applied for asylum.

However, parole will terminate automatically upon departure from the United States. Individuals with parole who plan to depart the United States and wish to return must first apply for advance parole in order to be considered for reentry into the United States.

​Продление пароля на один год относится только к тем украинцам, которыео въехали в США в феврале, марте и по 25 апреля 2022 года через Мексиканскую границу и получил гуманитарный пароль на один год. Это не относится к тем, кто приехал после 25 апреля по программе Uniting for Ukraine.

Пароль должен быть автоматически продлен еще на один год. Вам ничего не нужно делать. Только  проверять форму i-94 на сайте CBP,

CBP опубликует новые форма 94 с новыми датами. 

Дополнительно до конца апреля 2023 вам придет по почте письмо продляющее разрешение на работу на один год с даты истечения старого (то есть у вас не будет перерыва). Письмо придет по вашему почтовому адресу, который был указан в заявлении на разрешение на работу I-765.. Если вы переехали, срочно подайте форму AR-11 online и сделайте это правильно.

Остальных граждан Украины это не касается - тех кто приехал по туристическим и другим визам, и тех кто посил ПУ   политическое убежище после 25 апреля 2022 на границе с Мексикой, или тех у кого парольт на два года по прошрамме U4U..​

Если у вас нет разрешения на работу, вы можете его подать I-765 в USCIS. Украинцы по гуманитарному паролю не платят за первое заявление.

Пока не совмесм понятно будут ли продлевать пароль тем, кто уже подался на TPS или получил TPS.

По закону украинцы могут использовать несколько путей иммиграции одновременно, и это не влияет на то, подали ли вы на получение временной защиты (TPS), получили статус TPS или подали прошение о предоставлении убежища.

​Avoid Scams – Uniting for Ukraine and Processes for Cubans, Haitians, Nicaraguans, and Venezuelans

Uniting for Ukraine and the Processes for Cubans, Haitians, Nicaraguans, and Venezuelans, provide pathways for nationals of these countries and their immediate family members to come to the United States and stay temporarily in a 2-year period of parole.

USCIS is asking potential supporters and beneficiaries of these parole processes to be cautious of scams and rumors. There has been an increase in scams and predatory behavior targeting individuals from these countries who may be considered for parole under these processes. Scammers and other bad actors exploit their victims by creating uncertainty and misinformation. Find more information on scams and legal services on the USCIS Avoid Scams webpage.

Some common scams and misleading offers to be aware of include:
  • Government impersonators: Look out for scammers posing as USCIS officials. USCIS will only contact you through official government channels and will not contact you through your personal social media accounts (such as Facebook, Twitter, LinkedIn, etc.).
  • Misleading offers of support: Look out for individuals who attempt to contact you online or through your social media accounts to offer to be your supporter or connect you to a supporter in exchange for a fee or your biographic information, such as your passport number or date of birth. Supporters should be able to provide financial support to beneficiaries for up to a 2-year period of parole. Beneficiaries are not obligated to repay, reimburse, work for, serve, marry, or otherwise compensate their supporter in exchange for the potential supporter submitting Form I-134A, Online Request to be a Supporter and Declaration of Financial Support, on their behalf or for providing financial support while they are in the United States. Find more information on potential exploitation and abuse in the Understand Your Rights guide.
  • Scam websites: Some websites claim to be affiliated with USCIS and offer step-by-step guidance on completing a USCIS application, petition, or request. Make sure your information is from uscis.gov, dhs.gov, or is affiliated with uscis.gov. Make sure the website address ends with .gov.
  • Payments by phone or email: USCIS will never ask you to transfer money to an individual. We do not accept Western Union, MoneyGram, PayPal, or gift cards as payment for immigration fees. In addition, we will never ask you to pay fees to a person on the phone or by email.
  • Notarios Públicos and unauthorized practitioners of immigration law: In the United States, a notario público is not authorized to provide you with any legal services related to immigration benefits.

U4U Uniting for Ukraine and Afghan Parolees Eligible for Refugee Benefits I-765 Work Permit

Congress has recently passed laws relating to certain Afghan and Ukrainian parolees that have included language providing that parolees covered by the legislation “…shall be eligible for resettlement assistance, entitlement programs, and other benefits available to refugees admitted under section 207 of the Immigration and Nationality Act (8 U.S.C. 1157)....”

Under DHS regulations, refugees are authorized employment incident to status, and under current USCIS policy and practice, refugees are not charged a fee by USCIS for their initial Form I-765, Employment Authorization Document (EAD). Parolees, however, are not employment authorized incident to status, and must pay a fee (currently $410) for their EAD, unless the fee is waived or exempted.
To implement the statutory language “other benefits available to refugees” in the context of section 2502(b), P.L. No. 117-43 (Afghan parolees) and section 401 of Public Law 117-128 (Ukrainian parolees), USCIS is providing the benefits of employment authorization incident to status normally accorded to refugees and a no-fee initial (and replacement of an initial) EAD to Afghan and Ukrainian parolees so that they receive the same treatment as refugees.
Effective Nov. 21, 2022, Ukrainian and Afghan parolees, and their qualifying family members, with certain classes of admission are considered employment authorized incident to parole, which means that they do not need to wait for USCIS to approve their Form I-765, Application for Employment Authorization, before they can work in the United States.

This updated policy guidance applies to the following individuals, if their parole has not been terminated:
  • Afghan parolees whose unexpired Form I-94, Arrival/Departure Record, contains a class of admission of “OAR.” If you are an Afghan parolee covered under section 2502(b), P.L. No. 117-43 who did not receive an “OAR” class of admission on your Form I-94, please email U.S. Customs and Border Protection at [email protected] to update your class of admission, if appropriate;
  • Ukrainian parolees whose unexpired Form I-94 contains a class of admission of “UHP”; and
  • Ukrainian parolees whose unexpired Form I-94 contains a class of admission of “DT” issued between Feb. 24, 2022, and Sept. 30, 2023, and indicates Ukraine as the country of citizenship on the document.
For these parolees, their unexpired Form I-94 is an acceptable receipt they may present to their employer to show their identity and employment authorization for for the purposes of Form I-9, Employment Eligibility Verification. The receipt satisfies the Form I-9 requirement for 90 days from the date of hire (or in the case of reverification, the date employment authorization expires). Individuals who received a Form I-94 when they entered the United States should visit U.S. Customs and Border Protection’s Form I-94 page to view and print a copy of their Form I-94. If you do not have a passport, you can use your A-Number to retrieve your Form I-94 online at the site above by choosing “Get Most Recent I-94.” Enter your A-Number in the Document Number field and enter your country of citizenship or “USA” in the Country of Citizenship field.

After the 90-day period, parolees must present an EAD or unrestricted Social Security card and acceptable List B identity document from the Form I-9 Lists of Acceptable Documents (such as a state-issued driver’s license or identification card). Ukrainian and Afghan parolees must still file a Form I-765 to receive a physical EAD. USCIS will provide additional guidance for employers about completion of Form I-9, Employment Eligibility Verification.

Effective Nov. 21, 2022, USCIS is also exempting the fee to file Form I-765 for Ukrainian parolees filing for the first form I-765, application for an EAD by mail. Afghan parolees under OAW are already exempt from the fee for an initial paper-filed Form I-765 (and a replacement EAD) through Sept. 30, 2023.

Effective Dec. 5, 2022, USCIS will be able to process fee exemptions for online filings of Form I-765 for eligible Ukrainian and Afghan parolees. We encourage use of online filing for more efficient processing.

Если вы приехали в США по программе Uniting for Ukraine из Украины, с 21 ноября 2022 вы имеете право работать в США первые 90 дней без предварительного получения разрешения на работу, если на вашей карточке I-94 Admission Record о въезде в США стоит статус UHP или DT. 

Вы можете также подавать заявление на получение карточки соцстрахования на основании этой формы I-94 и штампа пароль в паспорте.

Чтобы получить саму карточку разрешение на работу, нужно подать заявление Form I-765 или по почте или онлайн в USCIS. C 21 ноября 2022 подача первого заявления I-765 по почте стала бесплатной для укаринских беженцев по программе U4U. С 5 декабря ожидается что подача первого I-765 также станет бесплатной онлайн (пока онлайн требует оплату). Эти новый изменения произошли из-за того, что Конгресс США приравнял статус пароль из Украины и Афганистана к статусу беженца.

Uniting for Ukraine New COVID-19 Vaccination Requirement

The U.S. Department of Homeland Security (DHS) has updated the COVID-19 vaccination requirements for beneficiaries paroled into the United States under Uniting for Ukraine. Effective immediately, all beneficiaries aged 6 months and older must have an attestation submitted attesting that they received COVID-19 vaccinations both before traveling to the United States and after arrival in the United States, unless they are eligible for an exception. Previously, beneficiaries younger than 5 years old qualified for an exception to the COVID-19 vaccination requirement because the vaccine was not approved or licensed for use in that age group.

Before Traveling to the United States

To receive travel authorization under Uniting for Ukraine, all beneficiaries aged 6 months and older must have an attestation submitted attesting that they received at least 1 dose of a COVID-19 vaccine approved or authorized by the Food and Drug Administration or a COVID-19 vaccine listed for emergency use by the World Health Organization, unless they are eligible for an exception.

After Arrival in the United States

After being paroled into the United States, all beneficiaries aged 6 months and older must have an attestation submitted attesting that they completed or will complete their COVID-19 vaccination series (in other words, they will be fully vaccinated) within 90 days of arrival or within 90 days of reaching the eligible age for vaccination according to the current Centers for Disease Control and Prevention guidelines, unless they are eligible for an exception.

The attestation is a condition of parole and must be completed in the beneficiary’s USCIS online account. See our Uniting for Ukraine Vaccine Attestation webpage for more information. Beneficiaries are responsible for arranging their vaccinations.

The U.S. received more than 100,000 Ukrainians in roughly five months following Russia's invasion of Ukraine, fulfilling President Biden's pledge of providing a temporary safe haven to those displaced.
Approximately 47,000 Ukrainians have come to the U.S. on temporary or immigrant visas; nearly 30,000 Ukrainians arrived under a private sponsorship program; more than 22,000 Ukrainians were admitted along the U.S.-Mexico border; and 500 Ukrainians entered the country through the traditional refugee system, the data show.

С сегодняшнего дня, все приехавшие с Украины по программе Uniting for Ukraine обязаны иметь вакцинацию от Ковида-19 начиная с 6-месячного возраста.

Разрешено иметь хотя бы одну прививку ДО приезда в США.

 Measles Vaccine (Select one):
  • I have received at least one dose of measles vaccine.
  • I am not vaccinated against measles but qualify for an exception to this requirement because I am younger than 12 months old or was born prior to 1957.
  • I am not vaccinated against measles, but qualify for an exception to this requirement because I:
    • Have a history of a severe (anaphylactic) reaction to a previous dose or to any component of the vaccine (such as gelatin or neomycin);
    • Am pregnant;
    • Had a recent blood transfusion or other blood products;
    • Have a known severe immunodeficiency; or
    • Have a family member (parent, brother, or sister) with a history of hereditary or congenital immune system problem.
Polio Vaccine (Select one):
  • I have received at least one dose of polio vaccine.
  • I am not vaccinated against polio but qualify for an exception to this requirement because I am younger than 6 weeks old.
  • I am not vaccinated against polio but qualify for an exception to this requirement because I have a history of a severe (anaphylactic) reaction to a previous dose or to any component of the vaccine.
  • I am not vaccinated against polio because the vaccine is not approved or licensed for use in my age group, but I will get vaccinated within 14 days of arrival in the US.
COVID-19 Vaccine (Select one):
  • I have received at least one dose of a US Food and Drug Administration (FDA) approved or authorized COVID-19 vaccine or a COVID-19 vaccine with World Health Organization Emergency Use Listing (WHO EUL). If not fully vaccinated, I will complete a recommended COVID-19 vaccine series within 90 days after arrival. If the COVID-19 vaccine I received cannot be determined or is not available in the United States, I will receive at least one dose of an FDA approved or authorized COVID-19 vaccine according to the guidelines: https://www.cdc.gov/vaccines/covid-19/clinical-considerations/interim-considerations-us.html

Attestation required within 90 days after U.S. arrival:
Tuberculosis Screening (Select one):
  • My test result is negative. I have undergone tuberculosis screening starting with an IGRA (interferon-gamma release assay) blood test, and my result is negative. I have and will retain my IGRA test result documentation.
  • My test result is indeterminate. I have undergone tuberculosis screening starting with an IGRA (interferon-gamma release assay) blood test and my results are indeterminate. An indeterminate IGRA result means additional testing is needed because I may have a tuberculosis infection which has not yet resulted in a positive IGRA test. I will follow up with a state or local public health office or doctor’s office and will complete any additional recommended testing to include further IGRA blood testing, chest x-ray, or other testing and treatment. I have and will retain my IGRA test result documentation.
  • My test result is positive. I have undergone tuberculosis screening starting with an IGRA (interferon-gamma release assay) blood test and this screening was positive for tuberculosis. I understand that prior Bacillus Calmette-Guerin (BCG) vaccination does not cause a positive IGRA result, thus a positive IGRA test must be taken seriously. I will receive a chest x-ray, and if abnormal, or other signs or symptoms of active tuberculosis disease are present, I will comply with isolation and treatment measures as determined by a state or local public health office or doctor’s office. I have and will retain my IGRA test result documentation as well as documentation that I followed up for additional testing and treatment.
  • I have not undergone tuberculosis screening but qualify for an exception to this requirement because I am younger than 2 years old.

  • I did not receive a polio vaccine prior to arriving in the United States because it was not approved or licensed for my age group, but I have now been vaccinated against polio.

As of July 2022 visa applicants from Ukraine may now undergo medical examination at the Sheptytskyy Hospital in Lviv.

How to Report Immigration Scams

Often we talk to someone who was a victim of immigration scam. For example, a notary (notario) helped to complete immigration paperwork and apply for immigration benefits that the person was not eligible for, of submitted a frivolous application for political asylum, which contained false information and was later denied. Or assisted in commuting "marriage fraud" to numerous other clients, and an innocent couple who was assisted by the same "notario" got their case denied and placed under investigation.

Please remember that in the United States only a licensed attorney (a lawyer) is authorized and qualified to give you legal advice, help with your immigration applications, forms, etc.

A Notary Public is not an attorney. To become a notary, a person has to pass a simple test, but doesn't have to be a lawyer, doesn't even need a college degree! (It is very different in Russia, Belarus, Kazakhstan, Ukraine, Europe or Latin America, which is why it is confusing to immigrants from those countries).

​For convenience of their clients, many lawyers also hold a license of a Notary Public in their state. However, these lawyers are licensed attorneys.

Please do not be fooled by people who offer to help with your immigration paperwork for "reduced fee". Or offer your "free legal advice". As they say, free is only the cheese in the mousetrap.

Reporting immigration scams will not affect your immigration application or petition.

How to Report Immigration Scams

Report the scam to your state consumer protection office. See the table below for state-specific information.

Scam Websites and Social Media AccountsSome websites and social media accounts claim to be affiliated with USCIS and offer step-by-step guidance on completing a USCIS application or petition. To report a website or social media account that claims to be affiliated with USCIS, send an email to [email protected].

Нередко нам приходится помогать людям, которым до нас "помог" нотариус или "иммиграционный консультант", и в результате испортил их шансы на получени грин карты и гражданства.

В США нотариусы не имеют право оказывать юридические услуги, в том числе иммиграционные услуги, такие как подача заявления на полит убежище и разрешение на работу. Для оказания таких услуг нужна лицензия адвоката (а не нотариуса).

В США нет иммиграционных консультантов (как в Канаде, например), которые в тоже время не являются юристами. В США только юрист может быть адвокатом и оказывать юридические услуги, в том числе иммиграционные услуги.

TPS for Ukraine Updates: Новости по ТПС для Украины.

Today, on July 14, 2022, I attended a conference call with the USCIS headquarters, and they provided important updates about TPS for Ukraine. 
Below are some of the talking points in English and Russian.

Cегодня 14 июля 2022 USCIS ответили на многие вопросы по ТПС для Украины во время конференции с адвокатами, которую я посетила.

1) USCIS is expecting that the processing time for TPS for Ukraine will be about 6 months. Soon, the processing times will be available at USCIS website. Ожидается, что сроки рассмотрения ТПС для Украины будут 6 месяцев. Скоро даты будут опубликованы онлайн на сайте USCIS.

2) Some TPS applications will be denied. The reasons for denial are inadmissibility grounds, criminal, frivolous asylum application (it is important!), reinstatement of a prior deportation order, etc. Некоторые заявления на ТПС получат отказ. 4) Be careful preparing your application and what documents you are submitting with your application.

5) Avoid immigration scams. Consult licensed attorneys, not notarios or someone says that they are a "paralegal" or "immigration consultant". USCIS sees a lot of fraudulent activity.

9) YES, you can have another valid Non-immigrant status while in TPS. However, you must maintain that status. There are rules to follow. 10) If you left Ukraine in a hurry and do not have some important documents, there is a way to submit "secondary evidence", and if accepted, it could be used instead of the missing documents from Ukraine.

12) TPS is issued individually to each applicant (to parents and children separately). You need to submit an application for each family member. There is no "derivative" TPS status. Uniting for Ukraine Program Opened Online on April 25, 2022

Новая программа “Единство для Украины” или Uniting for Ukraine открылась 25 апреля 2022. По этой программе граждане Украины и их ближайшие родственники (даже не граждане Украины), находящиеся за пределами США, могут получить ВРЕМЕННОЕ НА 2 ГОДА РАЗРЕШЕНИЕ приехать в США и временно остаться в США в течение 2-х лет на условиях гуманитарного ПАРОЛЯ.

Каждому приезжающему нужен спонсор по условиям этой программы.

Спонсор не обязательно должен быть родственником. Спонсор может быть и гражданином США, и постоянным жителем, и студентом, и на статусе TPS и т.п. Главное иметь достаточно средств для того чтобы спонсировать приглашенных украинцев.

Если вы хотите стать спонсором, вам нужно (1) создать свой аккаунт онлайн, и (2) заполнить форму I-134, Declaration of Financial Support, онлайн с детальным описанием и документацией подтверждающими вашу личность и финансовое состояние.
Эта форма I-134 - является только первым шагом в процессе пароля. Эта форма - 13 страниц, очень подробная, требующая детальной финансовой информации обоих спонсора и украинского беженца.

Правила и квалификция в программу достаточно детальные:
-- Гражданин Украины (или его ближайший член семьи без украинского гражданства), который находится за пределами США.
-- Ближайшие члены семьи это: Супруга или супруг партнера-граданина Украины, гражданский супруг или супруга и их неженатые дети в возрасте до 21 года.
--Если ребенку нет 18 лет, он должен путешествовать с одним из родителей или опекуном,
--Проживать в Украине непосредственно перед вторжением России (до 11 февраля 2022 года) и уехать в результате вторжения;
--Иметь гражданство Украины и ДЕЙСТВУЮЩИЙ украинский ПАСПОРТ (РЕБЕНОК МОЖЕТ БЫТЬ ВПИСАН в паспорт родителя или ИМЕТЬ СВОЙ ПАСПОРТ и путешествоаать с родителем);
--Или являться ближайшими родственниками гражданина Украины, попадающего под условия программы “Единство во имя Украины”;
--Иметь действительный украинский паспорт (это важно - без паспорта не будет возможности приехать в США по этой программе);
--Иметь спонсора (поручителя), подавшего форму I-134, которая была проверена и подтверждена USCIS;
--Пройти проверку фактов биографии, нет судимостей, и сдать биометрику;
--Иметь все необходимые прививки.
--Дети в возрасте до 18 лет должны ехать в США под опекой родителей или опекунов;
--Опекун должен заполнить и подать форму I-134 в USCIS и пройти проверку со стороны правительства США для защиты от эксплуатации и злоупотреблений, а также доказать, что он финансово состоятелен.
--Дети, путешествующие без родителей или законных опекунов, не имеют права на "пароль" в соответствии с программой “Единство для Украины”. По прибытии в пункт въезда в США ребенок, путешествующий без родителей или законных опекунов, может быть передан под опеку государства, а зетем в суд. Лучше не отправлять детей без родителей или опекунов.

Если спонсор одобрен USCIS, то украинская сторона получит емейл, подтверждающий это, и приглашение зарегистрироваться на официальном сайте my.uscis.gov.
После этого, украинская сторона предоставит свою информацию онлайн.

Если их заявление утвердят, то вы проверите свой аккаунт онлайн и увидите это подтверждение в своем онлайн аккаунте. Там будут все детали. По последней информации от USCIS DHS, визу получать не нужно будет в посольстве, а разрешение на въезд будет получено в вашем личном аккаунте.

Step 1: Financial Support

Individuals participating in Uniting for Ukraine must have financial support in the United States. A U.S.-based supporter will file a Form I-134, Declaration of Financial Support, with USCIS through the online myUSCIS web portal to initiate the Uniting for Ukraine process.
The supporter will then be vetted by the U.S. government to protect against exploitation and abuse, and ensure that they are able to financially support the individual whom they agree to support. Financial supporters must be verified and found eligible by the U.S. government before the Ukrainian beneficiary moves forward in the process.

Step 2: Submit Biographic

Information in myUSCISOnce a supporter has demonstrated sufficient financial support and is approved, the Ukrainian beneficiary will receive an email from USCIS on how to create an account with myUSCIS and instructions on next steps. The Ukrainian beneficiary will be required to confirm their biographic information in myUSCIS and attest to completing all eligibility requirements.

Step 3: Complete Vaccination Requirements

As part of confirming eligibility requirements in their myUSCIS account, individuals who seek authorization to travel to the United States via the Uniting for Ukraine process will need to confirm prior vaccination against measles, polio, and COVID-19. If not previously vaccinated, individuals will need to receive a first dose of required vaccines prior to obtaining travel authorization to come to the United States.

Step 4: Approval to Travel to the United States

After completing requirements, Ukrainians will receive a notice to their myUSCIS account confirming whether they are authorized to travel to the United States to seek parole. If approved, this authorization is valid for 90 days and Ukrainians are responsible to secure their own travel via air to the United States. Ukrainian citizens will need to meet other CDC travel requirements, including pre-departure testing for COVID-19.

Step 5: Seeking Parole at the Port of Entry

Upon their arrival at a port of entry, each individual will be inspected by U.S. Customs and Border Protection (CBP) and considered for parole for a period of up to two years, and may have conditions placed on their parole. All individuals two years of age or older will need to complete a medical screening for tuberculosis, including an IGRA test, within two weeks of arrival to the United States.
As part of the Uniting for Ukraine process, Ukrainians will undergo additional screening and vetting, to include biometric vetting. Anyone determined to pose a national security or public safety threat will be referred to U.S. Immigration and Customs Enforcement (ICE).
Ukrainians who present at U.S. land ports of entry without a valid visa or without pre-authorization to travel to the United States through Uniting for Ukraine may be denied entry and referred to apply through this program.

Step 6: Approved for Parole

If granted parole pursuant to this process, individuals will generally be paroled into the United States for a period of up to two years and are eligible to apply for employment authorization. Individuals may request authorization to work by filing a Form I-765, Application for Employment Authorization, with USCIS.


After the supporter files the Form I-134 with USCIS, we will review the form and supporting evidence to ensure that the supporter has sufficient financial resources to support the Ukrainian beneficiary for the duration of the parole period and conduct background checks on the supporter. We will determine whether the Form I-134 is sufficient, and we may request additional evidence to make our determination. If approved, Ukrainian beneficiaries will receive an email from USCIS with instructions on how to set up an account with myUSCIS and other next steps. Individuals should check their emails including spam and junk folders for important messages from USCIS.
If the Form I-134 is Sufficient
If we confirm the Form I-134 is sufficient, the Ukrainian beneficiary will receive an email from USCIS with instructions on how to set up an account with myUSCIS and other next steps. The Ukrainian beneficiary will be required to confirm their biographic information on myUSCIS and attest to completion of all requirements including:
An attestation to certify understanding of the family relationship requirements for children under 18 for Uniting for Ukraine.
An attestation that you have completed vaccine requirements or are eligible for an exception to vaccine requirements for Measles, Polio, and the first dose of an FDA approved or authorized COVID-19 vaccine or a WHO-Emergency use listed (EUL) COVID-19 vaccine.
Upon arrival to the United States, the beneficiary will need to attest to receiving a medical screening for tuberculosis, including an Interferon-Gamma Release Assays (IGRA) test, within 14 days.

If the Form I-134 is Insufficient
If we are unable to confirm the Form I-134 is sufficient, that decision is final. The Ukrainian beneficiary will receive an email from USCIS notifying them that the Form I-134 filed on their behalf was determined to be insufficient. The Ukrainian beneficiary will not be considered for parole under Uniting for Ukraine based on the insufficient Form I-134. However, the supporter may file a new Form I-134 on behalf of the same or another Ukrainian beneficiary, or a different supporter may file a Form I-134 on behalf of the beneficiary
Authorization to travel to the United States
Once the Ukrainian beneficiary has confirmed their biographic information and attested to completing all other requirements, their case will be further processed. Ukrainians will receive an email instructing them to check their myUSCIS account for the result of their authorization to travel. If the individual has been authorized to travel to the United States to seek parole pursuant to the Uniting for Ukraine process, they will be responsible to arrange and fund their own travel. This authorization is valid for a period of 90 days.

As of 04/26/2022:USCIS is only accepting online filing of Form I-134 by individuals agreeing to financially support Ukrainians and their immediate family members as part of Uniting for Ukraine program (not for any other programs or applications).You (sponsor or supporter) must be located in the United States to file form I-134 online.

Ukrainians seeking parole through Uniting for Ukraine may not file form I-134 on their own behalf.

The TPS designation of Ukraine enables nationals of Ukraine and individuals having no nationality who last habitually resided in Ukraine, and who have continuously resided in the United States since April 11, 2022, to file initial applications for TPS. The FRN provides instructions for applying for TPS and an EAD. TPS applicants must meet all eligibility requirements and undergo security and background checks.
TPS designation for Ukraine will go into effect on April 19, 2022, and individuals must also prove their continuous physical presence in the United States since the designation date. The FRNs explain the procedures necessary for an individual to submit an initial registration application under the designations and to apply for an EAD or an Employment Authorization.

Filing InformationUSCIS offers the option to applicants for TPS under Ukraine's designation to file Form I-821 and related requests for EADs online or by mail. When filing a TPS application, applicants can also request an EAD by submitting a completed Form I-765, Request for Employment Authorization, with their Form I-821.
Online filing: Form I-821 and I-765 are available for concurrent filing online.[50] To file these forms online, you must first create a USCIS online account.[51]
Mail filing: Mail your application for TPS to the proper address in Table 1.

Mail your completed Application for Form I-821, Temporary Protected Status and Form I-765, Application for Employment Authorization, Form I-912, Request for Fee Waiver, if applicable, and supporting documentation to the proper address in Table 1.TravelTPS beneficiaries may also apply for and be granted travel authorization as a matter of discretion. You must file for travel authorization if you wish to travel outside the United States. If granted, travel authorization gives you permission to leave the United States and return during a specific period. To request travel authorization, you must file Form I-131, Application for Travel Document, available at www.uscis.gov/​i-131. You may file Form I-131 together with your Form I-821 or separately. When filing the Form I-131, you must:
  • Select Item Number 1.d. in Part 2 on the Form I-131; and

If you are filing Form I-131 together with Form I-821, send your forms to the address listed in Table 1. If you are filing Form I-131 separately based on a pending or approved Form I-821, send your form to the address listed in Table 2 and include a copy of Form I-797 for the approved or pending Form I-821.Biometric Services Fee for TPSBiometrics (such as fingerprints) are required for all applicants 14 years of age and older. Those applicants must submit a biometric services fee. As previously stated, if you are unable to pay the biometric services fee, you may request a fee waiver, which you may submit on Form I-912, Request for Fee Waiver. USA announced plans to bring up to 100 thousand refugees from Ukraine

It was announced yesterday that the U.S. will accept up to 100,000 refugees from Ukraine to help with humanitarian crisis as a result of Putin's war.

As of today, this is just a promise and expression of intent. No further details, no application process has been established yet. Wait until the official rules are published.

Who is eligible to file a I-130 at USA Embassy abroad for an Immediate Relative of a US citizen

How to bring an immediate relative of a US citizen to the USA ASAP, if they are from Ukraine, Afghanistan, Ethiopia, and you are with them abroad. Immediate relatives are: spouses of a US citizen, unmarried children under 21 and parents of a US citizen (and you are over 21). Other relatives are not falling under the "immediate relative" category.

Как привезти близкого родственика в США в порядке ускорения: если вы американский гражданин, находитесь вместе с ними за пределами США, и ваш близкий родственник (муж, жена, незамужний ребенок до 21 года, родитель и вы старше 21 года), и ваш родственник из Украины, Афганистана или Эфиопии. Local Filing of Form I-130 Petitions Filed by U.S. Citizens on Behalf of Afghan, Ethiopian, and Ukrainian Immediate Relatives Fleeing Conflict

If you are a U.S. citizen who is physically present overseas with your Afghan, Ethiopian, or Ukrainian immediate family members and have not yet filed an immigrant visa petition with USCIS, you may request to locally file a Form I-130 petition at the nearest U.S. embassy or consulate that processes immigrant visas.  This applies only to U.S. citizens affected by the large-scale disruptive events in Afghanistan, Ethiopia, and Ukraine.  Such citizens must be physically present in the country where they wish to file petitions.  They can request to locally file on behalf of their spouses, unmarried children under the age of 21, and parents who fled Afghanistan after August 2, 2021; Ethiopia after November 1, 2020; or Ukraine after February 1, 2022. 
Please email your nearest U.S. embassy or consulate’s Immigrant Visa Unit if you believe you may qualify to locally file a Form I-130 petition.  You can find those email addresses at each individual embassy or consulate website.

Clarification About a Passport Requirement for Ukrainians

Recently, the US embassy in Warsaw posted on their website that they are accepting nonimmigrant visa applications from applicants from Ukraine "without a passport".

I contacted the US embassy in another EU country, and they advised:

"Please note, the guidance from Warsaw indicates that applicants may apply without a passport, not be issued a visa without one. Your client will need a passport in order to travel to the U.S. The best place to assist her in obtaining one is the nearest Ukrainian embassy."

You must have a passport for a visa to be issued.

You must have a passport in order to board the flight to the United States.

A Ukrainian biometrics "passport card" is not a passport needed for a visa to be issued. For a visa, you need a "passport book".

Embassy stressed out again that at this time the U.S. doesn't have a refugee program for Ukrainians, and advises people to apply in the EU country they are temporarily located.

Contact the nearest Ukraine embassy for advice and help with a passport.

IMMIGRANT VISAS
If you are a U.S. citizen or Legal Permanent Resident with a Ukrainian relative seeking to travel to the United States on an immigrant visa:
  • If you have an I-130 petition approved by USCIS pending processing at the National Visa Center (NVC) and want to transfer it to another Embassy, the designated processing post for Ukrainian Immigrant Visas is United States Consulate General Frankfurt, Germany: https://de.usembassy.gov/ukrainians-in-germany/. You may request expedition and transfer from the National Visa Center:  https://travel.state.gov/content/travel/en/us-visas/immigrate/national-visa-center/nvc-contact-information.html
  • If you have not yet filed a petition but wish to do so, you may contact U.S. Consulate General Frankfurt to inquire regarding possible local filing (this applies only to U.S. citizens filing petitions for their spouses, unmarried children under 21 and parents). Both the petitioner and the applicant must be present in Germany.
  • If you have an immigrant visa case that has already been transferred from NVC to Kyiv for the appointment and processing and you would like it to be processed in Frankfurt, please send an email request with your case number (KEV+10 digits) to U.S. Consulate General Frankfurt.

If you are a U.S. citizen with a Ukrainian fiancée/fiancé seeking to travel to the United States on a K1 visa:
  • If you have already filed a petition with United States Citizenship and Immigration Services (USCIS) that was not yet approved, U.S. law prohibits U.S. embassies from accepting K visa petitions (I-129F) for local filing abroad. USCIS must first approve K visa petitions. However, you can request an expedite for USCIS processing at https://www.uscis.gov/forms/filing-guidance/how-to-make-an-expedite-request
NONIMMIGRANT VISAS
Before applying for a nonimmigrant visa, consider carefully whether you are qualified for the visa you intend to apply for.  Nonimmigrant visas are for temporary stays in the United States and are not for refugees.  There are no nonimmigrant visas available for refugees.  If you apply for a nonimmigrant visa but do not intend to leave the United States, your application will be refused.
There are no “walk-up” appointments available at U.S. Embassy Warsaw or U.S. Consulate General Krakow. You must have an appointment in advance in order to interview for a visa.
If you are not qualified for a nonimmigrant visa, you may wish to refer to the humanitarian assistance information above.
If you are a Ukrainian who wants to travel to the United States or a U.S. citizen who has friends, business associates, or NON-IMMEDIATE family who want to travel to the United States on a nonimmigrant visa you should go to https://www.ustraveldocs.com/pl/en/nonimmigrant-visa and schedule your appointment:
  • Demand is extremely high, availability is low, and wait times and processing times are likely to be very lengthy. You may wish to refer to the humanitarian relief information above.
  • If you already have an appointment at U.S. Embassy Warsaw but wish to expedite it, you may request expedition via https://www.ustraveldocs.com/pl/en/expedited-appointment.
  • If you already began a nonimmigrant visa application process in Ukraine, you may send a request to [email protected]to ask for transfer of your “profile” to Warsaw or Krakow, after which you should be able to continue the process for an appointment in Poland. Please note that a visa fee paid in Ukraine cannot be transferred and that it is necessary to pay a new fee in Poland after a profile is transferred. If you are seeking but do not already have an appointment visit https://www.ustraveldocs.com/pl/en/step-4 and sign up for the first available appointment of the type you are eligible for.
  • If you do not have all your documents available, for example a passport, you may apply without these documents. A Consular Officer will inform you of any required next steps as part of the visa decision. (Edit 03/14/2022: as was explained by the US embassy in another EU country, a valid and unexpired "passport book" (not a biometric card) is still required for any US visa to be issued and for travel to the United States).
If you are a Ukrainian with a U.S. citizen/Legal Permanent Resident (LPR) spouse or parent and are seeking to travel to the United States on a nonimmigrant visa for temporary stay please visit https://www.ustraveldocs.com/pl/en/nonimmigrant-visa to schedule an appointment. 
  • Select the “Ukrainian with U.S. citizen or Legal Permanent Resident immediate family” category in step 3 when scheduling your appointment.
    • This category is only for a spouse or child of a U.S. citizen or Legal Permanent Resident.
  • If you are unable to schedule an appointment via the methods described above, you may instead request a “group appointment” via https://ustraveldocs.com/pl/en/group-appointments and suggest a date convenient for you. Once you have submitted your request, please wait for a response from the Embassy, which will come via email and should permit you to schedule an appointment.
    • The group appointment option is only available for a U.S. citizen or LPR with a Ukrainian spouse or child.  Other applicants who apply for the group method will be declined.

Legal Immigration Options for Ukrainians March 2022

What are legal immigration options for Ukrainian citizens trying to find a safe heaven in the United States during the war with Russia?

Since the beginning of the war on February 24, 2022, there are a few available options. These options may not apply to everyone. They may change. During the last week, there were many changes with consular processing of visas for Ukrainians. Situation is still very fluid. Here is a list of some possible options which should not be construed as legal advice. 

As of March 10th, the US didn't announce any new refugee program for Ukrainians yet.

The Biden administration previously said it would accept up to 125,000 refugees in the 2022 budget year. That annual cap had been cut to a record low 15,000 under President Donald Trump. In setting the annual target for refugees, the Biden administration set aside 10,000 refugee visas for people from Europe, but it could expand that number to take in more Ukrainians if needed. The White House has said it will work with the United Nations and European countries to determine whether people who have fled Europe will need permanent resettlement in the U.S. or elsewhere. The 125,000 does not include the 76,000 Afghans who came to the United States after the American withdrawal from Afghanistan in August.

(2) Если у вас нет визы в США, вы можете подать заявление на визу и попытаться ее получить в одном из американских посольств за пределами Украины (например, в Польше или Германии и в других). If you don’t have a visa to the U.S. you can apply for a visa at the US Consulate in the country outside of Ukraine. For example, in Warsaw, Poland, Krakow, Poland, Frankfurt, Germany, or other US embassies and consulates in other EU countries. You can submit a visa application online. Unfortunately, visa interviews are backlogged, and it might take a while to have one scheduled. Check the information current at the time you submit your visa application because information and advice changes almost daily.

Это рисковано и обычно не рекомендуется. If you don’t have a valid visa to the U.S., but you can get into one of the neighboring countries and if have reasons to fear persecution in Ukraine (not merely escaping war), you can apply for asylum at a designated US Border Checkpoint and be paroled into the United States. It is a risky procedure and usually we don't recommend it. This option includes detention time at the border or in jail/detention center before being allowed to enter the U.S. It is advisable to consult an attorney who specializes in political asylum and this kind of cases in advance. It is important to show that you have family or friends or anyone in the United States willing to be your sponsor, and to have valid documentation of your identity, such as a passport and a birth certificate.

(4) Если вы находились на территории США 1 марта 2022, и у вас нет судимостей, вы cможете подать заявление на временный статус TPS и разрешение на работу, когда начнется период приема заявлений. Следите за носвостями или проконсультруйтесь у адвоката о ваших шансах и процедуре подачи заявления. If you are already in the USA, and have been physically in the U.S. on March 1, 2022, you will be able to apply for a TPS (temporary Protected Status) for 18 months and a work permit, which would allow you to get an SSN and a driver’s license, so you can live and work in the USA on a temporary basis. Follow the new and announcements at USCIS website to see when the application can be submitted and read the instructions or consult an attorney before applying.

(5) Если вы находитесь за пределами США и у вас есть близкие родственники в США, вы можете подать заявление на гуманитарный пароль. If you are outside of the United States but have a close family in the U.S., you can apply for Humanitarian Parole. The application is filed in the U.S. with USCIS, form I-131 A relative must provide evidence of humanitarian reasons and financial support. It is not the fastest option and can take many months to be approved because it is currently backlogged since COVID-19 and Afghanistan crisis in summer of 2021. (6) Если ваши родные в США подали на вас петицию на воссоединение семьи, I-130, то в некоторых категориях можно попросить ускорение. If you already have a pending petition, you can ask USCIS to expedite it, if a US citizen or permanent resident is petitioning for their spouse, children, or parents.

You can contact the USCIS at (800) 375-5283 and request to expedite your case. Please note that expediting a petition for any relatives other than immediate family members of US citizens or permanent residents is not going to help to get them to the USA fast. At this time, if you have a petition for your sibling or a child over 21, an expedite request is not going to help, because the process for those relatives is not delayed due to a backlog but due to a congressionally annual limitations on the number of immigrant visas available and them waiting for a visa number to become available in their visa category.

(7) Если ваше дело на грин карту по воссоединению семьи находится в Национальном Визовом Центре или уже было утверждено и вы ждете интервью в посольстве, попросите ускорения. Дело нужно будет перевести в другое посольство США. В настоящее время это Франкфурт в Германии для украинских граждан. If your case is pending at the NVC or at the US embassy, you can ask to expedite it. To expedite a case which is at the consulate, you need to send an email directly to the US consulate and provide the case number you received from NVC, and ask the consulate to schedule a visa interview. You may need to request a transfer of the case from Kyiv to Frankfurt, Germany, if a case wasn’t transferred yet. The same limitation for relatives who are not immediate relatives applies.

(8) Если вы уже находитесь в США, вы можете подать заявление на политическое убежище, если у вас есть для этого основания (опасения преследований на основании одного их защищенных групп, а не только из-за войны). If you are already in the United States, you can apply for asylum or for relief from deportation if you fear persecution in your home country under one of the protected groups or categories. All deportations of the Ukrainian citizens were halted recently. Asylum procedures allow individuals, who have reasonable fear from returning to their home countries, to apply for asylum in the United States. To qualify for asylum the applicant must demonstrate that there is a reasonable possibility of persecution based on one of enumerated protected grounds.

(9) Если вы уже в США в статусе иностранного студента из Украины, вы можете подать заявление на разрешение на работу в связи с особыми обстоятельствами и попросить его ускорить. If you are already in the United States as a foreign student from Ukraine on a valid F-1 visa, you can apply for emergency work permit by filing a form I-765 with the USCIS and asking for emergency work permits due to unexpected financial hardships they are experiencing due to the situation in Ukraine. Do not travel to Ukraine due to armed conflict and COVID-19.  U.S. citizens in Ukraine should depart immediately if it is safe to do so using any commercial or other privately available ground transportation options.  U.S. citizens remaining in Ukraine should carefully monitor government notices and local and international media outlets for information about changing security conditions and alerts to shelter in place. DHS Designates Ukraine for Temporary Protected Status for 18 Months

DHS Designates Ukraine for Temporary Protected Status for 18 Months
WASHINGTON — The Department of Homeland Security (DHS) announced the designation of Ukraine for Temporary Protected Status (TPS) for 18 months.

A country may be designated for TPS when conditions in the country fall into one or more of the three statutory bases for designation: ongoing armed conflict, environmental disasters, or extraordinary and temporary conditions. This designation is based on both ongoing armed conflict and extraordinary and temporary conditions in Ukraine that prevent Ukrainian nationals, and those of no nationality who last habitually resided in Ukraine, from returning to Ukraine safely. These conditions result from the full-scale Russian military invasion into Ukraine, which marks the largest conventional military action in Europe since World War II. This invasion has caused a humanitarian crisis with significant numbers of individuals fleeing and damage to civilian infrastructure that has left many without electricity or water or access to food, basic supplies, shelter, and emergency medical services.

Individuals eligible for TPS under this designation must have continuously resided in the United States since March 1, 2022. Individuals who attempt to travel to the United States after March 1, 2022 will not be eligible for TPS. Ukraine’s 18-month designation will go into effect on the publication date of the forthcoming Federal Register notice. The Federal Register notice will provide instructions for applying for TPS and an Employment Authorization Document (EAD). TPS applicants must meet all eligibility requirements and undergo security and background checks.

Новости из Белого Дома. Пресс секретарь объявил, что США готовы принять беженцев (refugees) с Украины.

Вначале им нужно покинуть страну и стать беженцами - например, уехать с Украины в Европу, и затем подавать на статус беженца.

Если украинцы находятся на территории США, то они могут подавать на политическое убежище (political asylum), статус asylee.

On February 24, 2022, Russia invaded Ukraine, it's estimated that up to 5 million Ukrainians may flee their country. White House Press Secretary Jen Psaki told reporters the United States is ready to accept some of those refugees.

Since the invasion began early Thursday, Ukrainians fleeing the fighting have entered Poland, Romania, and Moldova, and there are centers set up at the borders to provide assistance.

In December 2021, Ukraine's defense minister estimated that between 3 and 5 million Ukrainians might be forced to leave their homes if Russia invaded. In comparison, about 1 million refugees entered Europe between 2015 and 2016 from Syria, Iraq, and Afghanistan, and nearly 1.5 million people were displaced in 2014 when Russia invaded Crimea.

The US embassy in Kyiv, Ukraine evacuated and all consular services were suspended. 

If you have a immigrant visa case assigned to Ukraine, consult your attorney to decide what to do, and if your case can be transferred to another US embassy in another country.

In Russian: с 12 февраля 2022 все консульские сервисы и выдача виз (даже без интервью, как вейвер) были приостановлены в посольстве США в Киеве в Украине. Более того, посольство было эвакуировано. По последним данным многие сотрудники выехали в Польшу после Львова.
Если у вас есть дело на иммиграционную визу (грин карту) по воссоединению семьи в посольстве в Киеве, обсудите с вашим адвокатом ваши шаги по переводу дела в доугое посольство США в другой стране, возможно ли это, что для этого нужно сделать.

On February 12, 2022, the Department of State ordered the departure of most U.S. direct hire employees from Embassy Kyiv due to the continued threat of Russian military action. The Department previously authorized the voluntary departure of U.S. direct hire employees and ordered the departure of eligible family members on January 23, 2022.
On Sunday, February 13, 2022, the Department of State suspended consular services to include interview waiver services at the U.S. Embassy in Kyiv. Applicants for U.S. nonimmigrant visas may apply in any country in which they are physically present and where there are appointments available. As each U.S. Embassy has specific application procedures, you should contact the U.S. Embassy or Consulate where you wish to apply directly. Contact information for U.S. Embassies and Consulates is available at www.travel.state.gov.
If you have an immigrant visa case currently pending with U.S. Embassy Kyiv and would like to transfer processing of an immigration case to another U.S. Embassy, you must contact the receiving U.S Embassy in that country to authorize and initiate transfer. The Embassy will have a list of requirements which must be satisfied in order to begin the transfer process.
